Terms of Service

These Terms of Service govern your use of apexpropertysolutionsmd.com and the cleaning services provided by Apex Property Solutions ("Apex", "we", "us"). By using this site or requesting an estimate, you agree to these terms.

1. Eligibility — 18 years and older

This website and our services are intended solely for adults. You must be at least 18 years old to use this site, to submit an estimate request, to consent to text messages, and to enter into any agreement with us. If you are under 18, do not use this site or provide any information through it. By submitting the estimate form you confirm that you are 18 or older and that the information you give us is accurate.

2. Estimates and services

• An estimate requested through this site is a good-faith quote based on the information you give us. It is not a binding contract until both parties confirm the scope, price and schedule.
• Final pricing may change if the actual condition, size or scope of the property differs materially from what was described. We will tell you before doing any work that changes the price.
• You are responsible for providing safe and lawful access to the property at the scheduled time, and for telling us about hazards, pets, alarm codes, fragile items or areas we should not enter.
• We may decline or stop work where conditions are unsafe, unsanitary beyond the agreed scope, or where access cannot be obtained.

3. Scheduling, cancellation and access

• Appointments are confirmed by phone, email or — where you have consented — text message.
• Please give us at least 24 hours' notice to cancel or reschedule.
• If our crew cannot access the property at the scheduled time and we were not notified, we may charge for the visit.

4. Payment

• Invoices are issued on completion of the work unless we agree otherwise in writing.
• Payment is due on the terms stated on the invoice.
• Recurring service continues at the agreed frequency and rate until either party ends it.
• Late payments may be subject to reasonable late charges and collection costs permitted by Maryland law.

5. Text messaging terms

These terms apply to the Apex Property Solutions SMS program. They form part of these Terms of Service.

• Program description. The program sends transactional text messages relating to an estimate you personally requested: follow-ups, scheduling, appointment confirmations and reminders. It is not a marketing or promotional program.
• Sender. Messages are sent by Jackson Cummings, the registered sender of record for Apex Property Solutions. Every message identifies Apex Property Solutions.
• How to join. Tick the optional SMS consent checkbox on the estimate form at apexpropertysolutionsmd.com. The box is unchecked by default and is not required to submit the form. Consent is not a condition of purchase.
• Message frequency. Message frequency varies, typically 2 to 6 messages per inquiry.
• Cost. Message and data rates may apply. Charges come from your mobile carrier, not from us.
• How to opt out — STOP. Reply STOP to any message at any time. You will receive one final confirmation that you have been unsubscribed, and we will send no further messages. You can reply START to opt back in.
• How to get help — HELP. Reply HELP to any message and you will receive our business name, phone number and email address. You can also call (410) 693-6346 or email [email protected].
• Age requirement. You must be at least 18 years old to consent to receive text messages from us.
• Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier's network and your device.
• Privacy. Text messaging originator opt-in data and consent are not shared with any third party. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
• Changing your number. Tell us if your mobile number changes, so that messages intended for you are not sent to someone else.

6. Acceptable use of this website

• Submit only your own accurate contact details, and only a phone number you personally control.
• Do not use this site to submit another person's information for text messaging.
• Do not attempt to disrupt, scrape, overload or gain unauthorised access to the site.
• Do not use the site for any unlawful purpose.

7. Satisfaction and claims

If something is not right with a service, contact us promptly and give us a reasonable opportunity to inspect and put it right. Claims for damage should be reported as soon as you notice them so that we can investigate while the facts are fresh.

8. Limitation of liability

To the fullest extent permitted by Maryland law, Apex Property Solutions is not liable for indirect, incidental, special or consequential damages arising from the use of this website or our services. Nothing in these terms limits liability that cannot be limited by law.

9. Intellectual property

The content, layout and branding of this website belong to Apex Property Solutions and may not be copied or reused without permission.

10. Governing law

These terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-law rules. Disputes will be brought in the state or federal courts located in Maryland.

11. Changes to these terms

We may update these terms. The "last updated" date at the top of this page shows when. Continued use of the site or our services after a change means you accept the updated terms.
